The Patan Judicial Court convicted the father and son in the case of firing in the air during a religious event in 2010, 14 years ago in Mehmedpur village of Patan taluka. The son was sentenced to three years simple imprisonment and Rs. 5000 and sentenced the father to simple imprisonment of six months and a fine of Rs. 2000. Also, if he does not pay the fine, he was ordered to serve six months and one month respectively.
Sentencing the Chief Judicial Magistrate of Patan A.S. Gohel said that considering the submissions of both the parties, the accused have committed a crime under Arm Act 27 (1), 29 (B) so that if punishment is not done, there is a possibility of such type of crime in society in future and such type of crime also gets indirect encouragement to maintain the balance of punishment. Punishment will deter people from committing such crimes in the future and will maintain the trust the society has in the judiciary. So to set a precedent, when the crime is proved under these clauses, the benefit of probation is not considered to be given to the accused.
