The Patdi Bar Association was enraged by the arrogant behavior of the Patdi Mamlatdar and submitted a petition to the Provincial Collector with a strong representation. In which senior and junior lawyers including the president, vice president and secretary of Patdi Bar Association came to present.
All the lawyers of Patdi Bar Association, who represented Patdi Province Collector Bhawanaba Jhala against the female Mamlatdar PK Modhwadia of Patdi taluk, said with outrage that Patdi Mamlatdar PK Modhwadia violated the rules of Gujarat Civil Service Rules 1971 and Gujarat Civil Service Rules 2002. Abuse of power involves insulting and misbehaving lawyers by making arbitrary decisions without considering the evidence in their court cases. In addition, the employer acts against the established rules and regulations with the intention of causing damage to the applicants for non-performance.
Moreover, despite being a public servant, instead of considering himself as a servant of the people, he considers himself above the people and the law. And yet plagued by the capricious nature of the monarchy. Also, if someone comes to visit them, they waste their precious time by sitting outside the office for hours. Further, court proceedings are held in closed doors and court proceedings should be held in open court and parties are sternly instructed not to stand and sit and not speak and misbehave as officials.
Apart from this, in the present case also the behavior is unbecoming of a public servant. In which the petitioners are not to retain a lawyer and I am not going to change my decision even if you retain a lawyer and compel the parties not to retain a lawyer in the presence of lawyers. And the people of the entire Dasada taluk have shouted trahimam from this Mamlatdar. Also applications for conversion of new condition to old condition are not considered for 6 months. In addition, despite the provision of not calling a public servant as per the Gujarat General Administrative Rules, if they are mistakenly told by their sister, ‘You should call me sir’, then they are suffering from their own inferiority complex. Also, the public or advocates are required to have a letter for visitation. And it has been submitted that their attendants are entering the chamber without any ticket.
Patdi Bar Association has not behaved in a way that respects the lawyers by adopting a hostile attitude towards the lawyers. Hence the lawyers of Dasada Taluk Bar Association, Patdi submitted a written petition to Patdi District Collector Bhawanaba Jhala to take appropriate judicial action for violation of Gujarat Civil Service (Discipline and Appeal) Rules 1971 and Gujarat Civil Service Rules 2002 along with Gandhinagar Chief Minister, State Revenue Secretary, Surendranagar. A written representation was also made to the District Collector.
