With this ruling, the complainant customer will have to pay the amount paid under the business loan along with interest by the bank and will be exempted from paying the outstanding loan installments. Also the insurance company has to pay the amount to the insured. Thus, the bank as well as the insurance company will have to pay an amount of 1 crore to the complainant customer.

Jayeshbhai K. was living at Koba in Gandhinagar. Gurjar took a loan of 80,00,000 on 30-6-2017 by mortgaging two properties from DCB Bank for commercial purpose. Meanwhile, on 19-5-2021, insurance holder Jayesh died due to a heart attack during treatment in the hospital during Corona. So Sarlaben Gurjar, the widow of the deceased, filed an application demanding the insurance company and the bank to provide the benefits under the policy. But the insurance company refused to pay the sum insured considering the death of the deceased as a major medical illness.
Filed a case in consumer protection court

While the representative present from ICICI Lombard General Insurance Company Limited replied that they have not received the Rs 50,000 shown as insurance premium in the bank statement. And prepared to give an affidavit that the statement of the bank has been wrongly stated.
