A 13-year-old girl living in Narol in Ahmedabad used to go to an academy to learn dance. The time of which was from 09.00 to 10.30 hours in the morning. But one day in 2018, I called Amarsingh Rajawate Taruni who runs RJ Academy of Dance at 08.30 am to learn dance. Where the dance teacher had a physical encounter with him.

The accused dance teacher called the girl early in the dance academy, put her on his lap, kissed her and hugged her. At this time no one is present at the dance academy so Taruni has to go to Pune and meet Dad. Having said that, she left. Later, Taruni told her grandmother about the whole matter. As soon as Taruni’s mother came to know, Taruni and Dadi had reached the dance academy. Where the dance teacher denied it. The girl’s mother called the police.

Based on the mother’s complaint, the Narol police registered an offense against the accused dance teacher under IPC 354, 354(A)(B) and sections 9, 10, 11 and 12 of the POCSO. Where the accused was detained by the police and produced in the court, he was sent to judicial custody. He was later released on bail.

The police collected the evidence and filed the charge sheet in the court. In which 04 witnesses and 10 evidences were presented. The case was heard in the court of Judge JK Prajapati in the Sessions Court. While the lawyer for the prosecution was PP Patni.

It was submitted by the defense counsel that the victim first narrated the incident to her grandmother, who was not made a witness. The minor did not shout at the time of the incident. CCTV footage of the incident has not been taken. If the accused is punished, the future of him and the children coming to his dance classes will be damaged.

It is worth mentioning that the accused used to teach Jadu ki Jappi dance to his students. The court rejected the argument of the defense and sentenced the accused to 05 years imprisonment.
