A 26-year-old youth living in Narol, Ahmedabad, along with his younger sister, who lives in front of her, entered the house and forcibly raped the accused, the Sessions Court of Ahmedabad has sentenced the accused to 20 years.

A 15-year-old and 04-month-old minor resident of Narol in Ahmedabad was alone at her home in April, 2021. His parents went out for labour. Then 26-year-old Atul, who was living in front of her house, broke into her house around 12 noon after consuming alcohol. Later he started physically assaulting the girl. The accused raped her twice by threatening to kill the girl against which she objected. At 01:00 in the afternoon, when the victim’s mother came home for dinner, Sagira seemed frightened. She pointed out that the accused is hiding under the bed.

The minor’s mother called the police and the police came and took away the accused. However, the minor did not get her period for two months and her mother asked her. Then Sagira told mother the whole incident of that day. Hence the minor’s mother filed a police complaint. The police registered a complaint against the accused under Sections 376(2), 376(3), 354(A), 450, 506(1), and Sections 3, 4, 5, 6, 8, 9 and 10 of the IPC. Based on the charge sheet, the case was conducted in the Ahmedabad Sessions Court.

It was argued by the counsel for the defense that why a complaint was filed against the accused after 108 days?, the victim’s clothes were not given to the police. However, the court rejected that argument. The court found that the victim was tribal and mentally unstable. Also, the accused had previously raped the victim twice. The prosecutor identified the accused in court. The court accepted the argument of the petitioner that being under the influence of alcohol cannot go in favor of the accused and the court sentenced the accused to 20 years.

Bharat Patni was the government advocate for the victim in the Sessions Court. The case was heard in the court of Judge JK Prajapati. In which 10 witnesses and 21 evidences were examined. It is worth mentioning here that the victim belonged to the tribe. She did not become pregnant in this case. The crime of atrocity has also been applied to the accused.
