Non-resident Indians (NRIs) and foreign nationals whose PAN (permanent account number) has been deactivated due to not being linked with Aadhaar will have to submit their residential address to the concerned assessing officer for its reactivation, the Income Tax Department said on Tuesday. Evidence has to be presented. The department said that some Overseas Indians/Overseas Citizens of Indian Origin (OCI) have raised concerns about their PAN being deactivated.

The Income Tax department wrote on Twitter that resident status is determined in respect of NRIs who have filed an ITR or informed the concerned Assessing Officer (JAO) about their residential status in any of the last three assessment years. According to the department, the PAN becomes inactive in cases where the NRI has not updated his residential status or filed returns in the last three assessment years.

NRIs have to ask their jurisdictional Assessing Officer to update the residential state in the PAN database. Details of Judicial Assessing Officer can be found by clicking on this link https://eportal.incometax.gov.in/iec/foservices.

The Income Tax Department said that NRIs who have applied for PAN under resident status and have not updated the residential status with the jurisdictional assessing officer and have not filed income tax returns for three assessment years, have their PAN deactivated. He has to inform the Judicial Assessing Officer at the link https://eportal.incometax.gov.in/iec/foservices/ to update the residential status in the PAN database along with supporting documents.

Income tax department said that inactive PAN is not active PAN. Despite this, anyone can file income tax return even though PAN is inactive.

“NRIs whose PAN is inactive are requested to submit relevant documents to their respective Assessing Officers with a request to update their residential status in PAN related information,” the Income Tax Department wrote on Twitter.
